1. Agreement to Terms
These Terms of Service form a binding agreement between the user and Jackson Baker, the operator of FitPulse and the seller identified for FitPulse on the applicable app store, governing access to and use of the FitPulse application and related services (the "Service"). By creating an account or using the Service, the user accepts these terms in full. Where the user does not accept them, the Service must not be used. The FitPulse Privacy Policy describes how personal information is handled. On Apple platforms, Apple’s Standard Licensed Application End User License Agreement also applies, and controls to the extent of any conflict with these terms.
2. Eligibility and Age Requirements
The Service is available to individuals who are at least 14 years old. The application enforces that minimum at sign-up, and an account identified as belonging to a person under 14 is removed. Where local law requires the consent of a parent or guardian below the age of majority, the user represents that such consent has been obtained. Registration information must be accurate and kept current.
3. Accounts and Account Security
The user is responsible for the account, for the confidentiality of sign-in credentials, and for all activity conducted through the account. Accounts may not be shared, sold or transferred. An account may be deleted at any time under Settings → Delete account, which removes the associated data as described in the Privacy Policy.
4. Description of the Service
FitPulse records training, nutrition, recovery and related activity; derives estimates from that record, including calorie and macronutrient figures, readiness scores and estimated one-rep maxes; and provides coaching based on those estimates. Features may be added, modified, suspended or discontinued at any time.
5. Health, Nutrition and Safety Disclaimers
FitPulse provides fitness estimates and general information, including readiness scores, calorie and macronutrient targets, artificial intelligence meal analysis and coaching. It is not medical, nutritional, or professional advice, is not a substitute for a physician, dietitian or trainer, and is not a medical device. Nothing provided through the Service is intended to diagnose, treat, cure, or prevent any disease. Users should consult a qualified professional before beginning or changing a training or nutrition programme, and should stop and seek medical attention if they feel unwell. Training and dietary decisions are made at the user’s own risk.
6. Estimates and Accuracy
Meal analysis, estimated one-rep maxes, readiness, recovery and calorie figures are approximations only and may be inaccurate. Values should be reviewed and corrected before being relied upon. FitPulse must not be used to manage a medical condition or an eating disorder.
7. User Content and License Grant
Users retain ownership of the content they submit, including logged entries, photographs, group posts and messages ("User Content"). By submitting User Content, the user grants FitPulse a non-exclusive, worldwide, royalty-free licence to host, store, reproduce and display that content solely in order to operate the Service and deliver it to that user and, where the content is posted to a group, to the members of that group. The licence ends when the content is deleted, except for copies retained in routine backups for a limited period. FitPulse does not use User Content to train artificial intelligence models. Users represent that they hold the rights necessary to submit the User Content they upload.
8. Objectionable Content and Abusive Behaviour
There is zero tolerance for objectionable content or abusive behaviour in profiles, groups, group chat and social feeds, including harassment, threats, hate speech, sexual content, spam and impersonation. FitPulse uses automated text filters to prevent known objectionable terms from being published in profile text, group names and descriptions, group messages and captions, and text attached to shared group or friend activity. Automated filters may miss context. New profile photographs are checked by OpenAI before they are published, after the user receives the screening disclosure and consents. Rejected or unchecked photographs are not published. Automated image screening can miss objectionable content. New uploaded group-logo photographs and group-chat images remain disabled. Images published through earlier versions may remain visible and are reportable; users can remove an existing profile photograph, group administrators can replace legacy group logos and remove legacy chat images, and FitPulse may remove reported content. Messages and member profiles may be reported from their menus, and a whole group may be reported under Group settings → Report this group. A user may be blocked from the member or profile controls. Reports are reviewed, content that breaks this rule is removed, and the accounts that post it are ejected. We aim to act on reports within 24 hours.
9. Prohibited Uses
The Service is licensed for personal, non-commercial use. Users must not misuse the artificial intelligence features or submit content intended to manipulate them; attempt to circumvent security controls, rate limits or entitlement checks; access another user’s account or data; scrape, reverse engineer, decompile or copy the Service; upload content they do not have the right to share; or use the Service in violation of any applicable law.
10. Subscription, Billing and In-App Purchases
FitPulse Pro is an auto-renewing subscription. Purchases are billed by the App Store or Google Play to the store account used for the purchase; FitPulse does not process payments directly. The price, billing period, and any introductory trial for which the store account is eligible are displayed before purchase. Unless cancelled during the trial, a trial converts to the paid subscription shown on the purchase screen. A subscription renews for a further period unless it is cancelled at least 24 hours before the end of the current period. Subscriptions are managed and cancelled in the store account settings; cancellation stops the next renewal and does not shorten a period already paid for. Deleting the application or the FitPulse account does not cancel store billing. Prices may change, with notice given before a change takes effect. Apple refund requests are decided by Apple. Google Play refunds may be handled by Google or FitPulse under the applicable policy and law. A refund request should be initiated through the relevant store or FitPulse support.
11. Third-Party Services
Food search and barcode lookups are answered by Open Food Facts, an open community food database. The search text or scanned barcode is sent to that service in order to retrieve results; the user’s account is not. Entries in that database are contributed by volunteers and may be inaccurate or incomplete, so values should be checked before a meal is saved. Artificial intelligence features are provided by OpenAI, as described in the Privacy Policy. Apple Health and Health Connect are provided by Apple and Google respectively and are governed by their own terms. FitPulse does not control third-party services and is not responsible for their content, accuracy or availability.
12. Intellectual Property
The Service, including its software, design, text, graphics, exercise catalogue and instructional media, is owned by FitPulse or its licensors and is protected by intellectual property laws. No right or licence is granted other than the limited, revocable, non-transferable right to use the Service in accordance with these terms.
13. Termination
A user may stop using FitPulse and delete the account at any time in Settings. FitPulse may remove content that breaks these terms and may suspend or close an account that breaks them, in particular the requirements of the section on objectionable content and abusive behaviour. Where an account is closed, any subscription purchased remains managed by the applicable app store and must be cancelled there.
14. "AS IS" and "AS AVAILABLE" Disclaimer
The Service is provided "as is" and "as available", without warranties of any kind, whether express, implied or statutory, including any implied warranty of merchantability, fitness for a particular purpose, title, non-infringement, or accuracy of any estimate or recommendation produced by the Service. FitPulse does not warrant that the Service will be uninterrupted, timely, secure or free of error.
15. Limitation of Liability
To the fullest extent permitted by law, FitPulse is not liable for any injury, loss, or indirect, incidental, special, consequential or punitive damages arising from use of the Service, including reliance on any estimate or recommendation it produces. To the fullest extent permitted by law, total aggregate liability arising out of or relating to the Service is limited to the greater of the amount paid for the Service in the twelve months preceding the claim or twenty-five United States dollars. Some jurisdictions do not permit certain limitations, in which case those limitations apply only to the extent permitted.
16. Applicable Law
These terms are governed by applicable law. Nothing in these terms deprives a user of mandatory consumer protections or forum rights available under the law of the user’s place of residence. On Apple platforms, the governing-law provision in Apple’s Standard EULA also applies where required.
17. Severability and Waiver
Where any provision of these terms is held to be unenforceable, that provision is modified to the minimum extent necessary to make it enforceable and the remaining provisions remain in full force. A failure to enforce a provision is not a waiver of it.
18. Changes to These Terms
These terms may be updated as the Service evolves, and the effective date shown at the top of this page is revised accordingly. Where required by law, notice of a material change is provided before it takes effect. Continued use of FitPulse after an effective update constitutes acceptance of the current terms.
19. Contact Information
Questions about these terms may be sent to [email protected].
